  1. General 

Below are Exclusive Costa Padel terms & conditions. It is important that you read, understand and accept these conditions. The lead booker/buyer who signs the completed booking form will be signing on behalf of all parties travelling that they have read and understood the below. If you have any questions concerning any of these conditions please feel free to contact us at any time.

2. Terms of Use of the Website

Use of the Exclusive Costa Padel website is based on the terms and conditions contained below. If you do not agree to these Terms and Conditions we politely request that you stop using the website immediately. By using the Exclusive Costa Padel website you are indicating your acceptance to be bound by these Terms and Conditions listed below. These Terms and Conditions are a legal agreement between you and us and can only be amended with our consent. The Terms and Conditions should be read in conjunction with the details provided within this website about how the website operates and the available padel holidays.


2.1 Any bookings of a padel holiday are also subject to our Booking Conditions. Users are also invited to read our Privacy Policy.

2.2. Exclusive Padel Experience reserves the right to change these Terms and Conditions from time to time without prior notice by changing them on the Site.

3. Accuracy of Information 

We carefully check and use all reasonable endeavours, to ensure the information regarding accommodation, padel services and arrangement is accurate (including prices), within brochures, newsletters, quotations, promotional material and throughout our website. However, errors and changes can occasionally occur. Exclusive Costa Padel regrets any possible inconvenience this may cause and would advise you to check the details of your trip and the prices before confirming your booking and Exclusive Costa Padel issue your booking confirmation.

If you find any inaccurate information on our website, please let us know immediately and if we agree we will ensure that it is corrected as soon as possible.

4. Governing Law and Jurisdiction

This contract and any dispute, claim or other matter of any description which arises out of or in connection with this contract is governed by and shall be construed in accordance with Spanish law. The Courts of Spain shall have jurisdiction to decide any dispute or claim that arises out of, or in connection with this contract.

5. Pricing & Payment

The prices applicable to the services and products are those indicated on the website. Prices are based in Euros (€) and include the applicable IVA/VAT (Value Added Tax) in Spain. 

However, in accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax, the operation may be exempt or not subject to said tax depending on the country of residence of the buyer/lead booker and the condition in the buyer that acts the same (businessman / professional or individual). Consequently, in some cases, the final price may be altered with respect to that shown on the website. In order for us to issue the corresponding invoices, you must let us know your country of residence to "info@exclusivecostaexperience.com" . 

We reserve the right to alter the price of any Padel holiday, not limited to any pricing error, and we will advise you of the current price of the Padel holiday before any booking. Any subsequent reduction in prices due to special offers advertised will not apply to confirmed bookings.

(5.1) Payment Methods

The buyer agrees to pay for the services and products purchased from Exclusive Costa Padel in the accepted forms of payment and for any additional amount (including taxes, fees and late payment charges, as appropriate).

We accept payment by bank transfer directly into our account.

(5.2) Deposit Payment

A deposit of 50% per person must be paid at the time of booking. In the case of cancellation on behalf of the client, a basic non-refundable fee of 175 EUR will be maintained. This money retained depends on the time of cancellation as mentioned in the Cancellation Policy (8.2).

We reserve the right to ask for an additional deposit amount for certain bookings where we need to pre-pay to the supplier(s) an additional sum to secure a booking. The balance of the price of your service/product must be paid no later than 4 weeks in advance of your date of travel, (the “Balance Due Date”). In some cases bookings may require full payment more than six weeks in advance of travel, however this will be advised to you at the time of booking. If the deposit, balance or final balance (as applicable) is not paid by the Balance Due Date, Exclusive Costa Padel reserves the right to cancel your booking and retain your deposit paid.

6. Changes to Price

We reserve the right to increase the price of your holiday after booking if any increase in price occurs in respect of:

(6.1) Taxes or duties payable, including new taxes introduced by any government

(6.2) Adverse changes to currency exchange rates

(6.3) Value Added Tax, depending on the country of residence of the buyer 

In all cases, if there is an increase in the cost of your holiday over 2%, this will be payable by you. If the cost of your holiday increases by more than 10% you may decide to cancel the holiday and have a full refund except for any services like non-refundable deposits or elements that have already been booked in your name. If you want to cancel you must inform us in writing within 7 days of being advised of the increase.


7. Booking Confirmation 

After we have taken a deposit or full payment has been received, Exclusive Costa Padel will then email you a booking confirmation, which will set out full details of your booking and show any remaining balance to be paid, and the date by which it is due. For any type of booking, whether by telephone, WhatsApp or by email, a contract between you and us will only exist when we issue the booking confirmation. Please contact us within 48 hours of receiving the booking confirmation if any information appearing on the confirmation or any other document appears to be incorrect or incomplete, as it may not be possible to make changes later. 


8. Cancellations/amendments made by you

If, once your booking confirmation has been issued by us and you want to change the numbers of persons in your booking, transfer your holiday to another person, or cancel your holiday, the person who originally booked the holiday (the lead name) must notify us in writing by email, telephone or WhatsApp. Availability and prices are subject to change in this instance.

(8.1) Cancellation Policy 

All cancellations must be in writing. The date Exclusive Costa Padel receives the confirmation of cancellation is deemed as the effective cancellation date and the cancellation charge conditions apply from that date, as detailed below.

Cancellation Period before departure

Charge – % of holiday cost retained by Exclusive Padel Experience

30 Days or less - 100% holiday charge retained

31-45 Days - 75% holiday charge will be retained or possible to switch to another holiday trip date

46-60 Days - 50% holiday charge will be retained or possible to switch to another holiday trip date

61 Days Plus - A non-refundable fee of 175 EUR will be retained per booking

We may incur costs when cancelling confirmed bookings, particularly if cancellations occur close to the departure date of your padel trip. In these circumstances, we will pass on these fees to you. If you cancel your holiday or the number in your group booking reduces before the Balance Due Date, we have the right to retain all monies paid by (or due from if still outstanding) each person cancelling as a cancellation fee. If you cancel on or after the Balance Due Date you will be charged a cancellation fee which is the amount equal to the amount paid for your trip to date as per the cancellation policy in 8.1. If you have already paid your balance at the time of cancellation, we are entitled to retain the cancellation amount for the balance paid as per the cancellation policy in 8.1.  Note that if the reason for your cancellation is covered under the terms of your personal travel insurance policy, you may be able to reclaim these charges via your insurance.


9. Cancellations/Amendments made by us

9.1 In certain circumstances we may have to cancel your Padel holiday, and if this should occur, we will return all monies you have paid to us for the specific holiday that we need to cancel, or offer you a suitable alternative such as a different trip date. However, we will not cancel your holiday after the balance due date, unless:

(9.1.1) you have not paid for your holiday in full, or
(9.1.2) your holiday is influenced by "force majeure" (as defined in clause 15 below). If "force majeure" does come into effect then we can try to arrange an alternative date or you can claim on your travel insurance.

9.2 Changes - most changes are minor and we will advise you of them at the earliest possible date. Occasionally, we have to make a “significant change” and we will tell you of any such change as soon as reasonably possible if there is time before departure.

Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so. 

10. Flights

Flights are not included in the cost of your padel trip. You have the responsibility to book your own flights. There are several airlines that fly into both Malaga and Gibraltar. If you book in advance you can get flights for very reasonable prices.


11. Our Liability to you 

When you book a padel holiday with us we accept responsibility in accordance with this paragraph that the holiday is as described and is of a reasonable standard. This is the case whether we are providing the service directly or whether we agree with someone else to provide parts of the holiday. This responsibility extends to arrangements in respect to excursions, equipment hire etc.

We cannot accept any liability for any delay in your outward or inward flight/s, regardless of the weather, airline rescheduling, industrial action, mechanical failure, medical outbreaks or an act of terrorism that causes the cancellation or delay. We will give no refunds or compensation for lost time and services from the itinerary.

Nothing in these booking conditions affects your statutory rights. Please note that where the cause of your loss, damage or injuries is due to our agents, suppliers or subcontractors, our acceptance of any liability is subject to you providing us your rights against them and cooperating with us in any legal action we may take against them.

12. Insurance

It is compulsory for all padel trips, that each client/traveller has adequate medical insurance, covering personal accidents, medical expenses and repatriation required for the trip.

13. Travel Documents - Passports, Visas and Health 

It is the sole responsibility of each travelling member to ensure that they have a valid passport and any valid visas and permits required for your destination. We do not accept any liability if you are refused transportation by any carrier or entry into any country due to your failure to carry correct documentation. You must also have any medical certificates that may be required.

It is and remains the responsibility of the ‘lead name’ to check and make sure with the country’s relative embassy that details are correct. Exclusive Costa Padel does not accept responsibility if your documentation is not valid, resulting in refused travel, entry and any associated cost.


14. Special Requests and Medical Problems

If you have any special requests you must advise us at the time of booking. Although we will endeavour to pass any reasonable requests on to the relevant supplier, we cannot guarantee any request will be met or actioned. 

If you or any member of your party has an existing medical or disability that may require assistance, or if you are diagnosed after you confirm your booking with us, please tell us before you book as soon as possible after you become aware. If we or the supplier in question reasonably feels unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline your booking or, if full details are not given at the time of booking, cancel when we become aware of these details.


15. Force Majeure

In these booking conditions, “force majeure” means any event which we or the supplier could not, even with all due care, foresee or forestall. Such events may include, without limitation, war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire, epidemics and pandemics and all similar events outside our or our suppliers’ control.

16. Data Protection

In order to process your booking and to ensure that your arrangements run smoothly and meet your requirements, we need to use the personal information you provide such as name, address, and any special needs/dietary requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information and we will comply with the Data Protection Act 1998. In order to issue your booking we must pass the information on to the relevant suppliers of your arrangements such as the padel club, hotels, transport companies and/or local tour agencies/providers. The information may also be provided to security or credit checking companies, credit and debit card companies, and regulatory or public authorities such as customs or immigration if required by them, or as required by law. This may involve sending your personal information between different countries, including countries outside the European Economic Area (EEA) where controls on data protection may not be as strong as the legal requirements in this country. This may also apply to any sensitive information that you give to us such as details of any disabilities or dietary/religious requirements. If we cannot pass your personal information on to the relevant suppliers, whether in the EEA or not, we cannot properly issue your booking. By providing us with your personal information, you consent to our use of that data as specified. Please see our Privacy Policy for further information about the use of personal information. By providing your personal information to us you are deemed to have accepted the terms of the Privacy Policy.

17. If you have a complaint

If you have a complaint while on holiday you must notify Exclusive Costa Padel on +34 645 22 78 78 or via email at info@exclusivecostaexperience.com, so we have every opportunity to immediately rectify any issue if possible.

Failure to do so may result in your ability to claim compensation being reduced or removed completely. Should you feel your complaint was not dealt with satisfactorily you must notify Exclusive Costa Padel in writing within 28 days of your return home. Exclusive Costa Padel will then investigate your complaint
